The Platform is owned by Indipack Machinery, a partnership firm incorporated in the year 2022-2023, with its registered office at 'Paribar Industrial Complex', Vill-Mollaber, Para-Chakundi Star Battery, PS-Dankuni, PO-Mollaber, Rishra, Hooghly, West Bengal, PIN-712250 (hereinafter referred to as "Indipack").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with 'Indipack Machinery' and these terms and conditions including the policies constitute Your binding obligations, with Indipack.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person or representative of any company or Firm who has agreed to become a user on the Platform by providing Registration Data while registering on the Platform as Registered User using the computer systems. Indipack allows the User to surf the Platform without registering on the Platform. The term "We", "Us", "Our" shall mean 'Indipack Machinery'.

When You use any of the services provided by Us through the Platform, including but not limited to, (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.

We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. It is Your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Indipack Policies (including but not limited to Privacy Policy available at Privacy) as amended from time to time.

1. MEMBERSHIP ELIGIBILITY

   Transaction on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years, you may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian.

   As a minor if you wish to transact on the Platform, such transaction on the Platform may be made by your legal guardian or parents. Indipack reserves the right to terminate your membership and / or refuse to provide you with access to the Platform if it is brought to Indipack's notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.

2. YOUR ACCOUNT AND REGISTRATION OBLIGATIONS

   If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform.

   Your e-mail address is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Platform.

   You agree that Indipack shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Website Platform.

   If You share or allow others to have access to Your account on the Platform (“Account”), by creating separate profiles under Your Account, or otherwise, they will be able to view and access Your Account information. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

3. COMMUNICATION AND UNSUBSCRIPTION

   By accepting the Terms of Use, you also accept to receive news, updates, offers/ campaign related SMS, to the mobile phone number provided by you. By accessing and using the Platforms and/or verifying your contact number with us, you explicitly consent to receive such communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings, even if your contact number is registered under the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.

   You can unsubscribe/ opt-out from receiving marketing/ promotional communications, newsletters and other notifications from us at any time by following the instructions set out in such communications.

4. DISCLAIMER OF WARRANTIES, INACCURACIES OR ERRORS

   We will try to ensure that all information and recommendations, whether in relation to the Products, Services, offerings or otherwise (hereinafter “Information”) provided as part of the Platforms is correct at the time of inclusion on the concerned Platform. We do not guarantee the accuracy of the Information. We make no representations or warranties as to the completeness or accuracy of Information.

   You agree that Information is being supplied to you on the condition that you will make your own determination as to the suitability of such information for your purpose prior to use or in connection with the making of any decision. No Information on the Platforms shall constitute an invitation to invest in us or any affiliates. Any use of the Platforms or the Information is at your own risk. Neither we, our affiliates, nor their officers, employees or agents shall be liable for any loss, damage or expense arising out of any access to, use of, or reliance upon, this website.

   As a means to assist the users in identifying the Products of their choice, we provide visual representations on the Platforms including graphics, illustrations, photographs, images, videos, charts, screenshots, infographics and other visual aids. While reasonable efforts are made to provide accurate visual representation, we disclaim any guarantee or warranty of exactness of such visual representation or description of the Product, with the actual Product ultimately delivered to users. The appearance of the Product when delivered may vary for various reasons.

5. ONLINE PAYMENT

   Our website does not provide any facility for online monetary transaction over this platform. User has to select the products and request for a call back for getting quotation. Accordingly, our represenative will contact the user on the contact details provided by the user in our platform.

6. USE OF THIS PLATFORM

   1. You represent and warrant that:
      1. your use of the Platforms and/or Services will not violate any applicable law or regulation;
      2. all information that is submitted to us in connection with the Platforms and/or Services is true, accurate and lawful;
      3. use of the content and material you supply does not breach any applicable Agreement and will not cause injury to any person or entity (including that the content or material is not defamatory).If at any time, the information provided by you is found to be false or inaccurate, we will have the right to reject registration, cancel all orders, and restrict you from using the Services and other affiliated services in the future out any prior intimation whatsoever. You agree to indemnify us and our affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties.
   2. You will use the Platforms for lawful purposes only and will not undertake any activity that is harmful to the Platforms or its content or otherwise not envisaged through the Platforms. You have a limited license to access and use the Platforms solely for the purpose of availing the Services, subject to these Terms of Use.
   3. You will not do any of the following:
      1. Delete or modify any content on the Platforms, including but not limited to any information regarding the Services, their performance, sales or pricing, legal notices, disclaimers or proprietary notices such as copyright or trademark symbols, logos, that you do not own or have express permission to modify;
      2. Decompile, reverse engineer, or disassemble the content on the Platforms;
      3. Use the Services in any way that is unlawful, or harms Indipack or any other person or entity, as determined in Indipack’s sole discretion;
      4. Use any engine, software, tool, agent or other mechanism (such as spiders, robots, avatars, worms, time bombs, Easter eggs, cancel bots, intelligent agents, etc.) to navigate or search the Platforms;
      5. Make false or malicious statements against the Services, the Platforms or us;
      6. Post, copy, submit, upload, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise disrupt or damage the Platforms and/or Services or any connected network, or otherwise interfere with any person or entity’s use or enjoyment of the Platforms and/or the Services;
      7. Introduce any trojans, viruses, any other malicious software, any bots or scrape the Platforms for any information;
      8. Probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us or otherwise tamper or attempt to tamper with our technological design and architecture;
      9. Hack into or introduce malicious software of any kind onto the Platforms;
      10. Gain unauthorized access to, or interfere with, or damage, or disrupt the server on which the details connected to the Services are stored, or any other server, computer, or database connected to the Services; or
      11. Engage in any form of antisocial, disruptive, or destructive acts, including “flaming,” “spamming,” “flooding,” “trolling,”, “phishing” and “griefing” as those terms are commonly understood and used on the internet.
   4. You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing on or through the Platforms, any information that:
      1. is libellous, defamatory, abusive, threatening, harassing, hateful, and offensive or otherwise violates any law or right of any third-party;
      2. belongs to another person and to which you do not have any right;
      3. is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, hateful, relating to or encouraging money laundering or gambling, or otherwise harmful in any manner whatsoever;
      4. harms minors in any way;
      5. infringes any patent, trademark, copyright or other proprietary rights;
      6. violates any law for the time being in force;
      7. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
      8. impersonates or defames another person; or
      9. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

7. AREA OF SERVICES

   We donot supply products to all parts of India, due to our limited resources. We reserve the right, at Our sole discretion to agree or disagree to supply the requested products, based on the delivery location.

   We do not supply outside India.

8. RETURN POLICY

   Definition: 'Return' is defined as the action of giving back the item purchased by the Buyer to the Seller on the Platform. Following situations may arise:

   • Item was defective
   • Item was damaged during the Shipping
   • Products was / were missing
   • Wrong item was sent by the Seller.
   • Return could also result in refund of money in most of the cases
   
   Points to be noted:
   We encourage the Buyer to review the listing before making the purchase decision. In case Buyer orders a wrong item, Buyer shall not be entitled to any return/refund.

10. APPLICABLE LAW AND JURISDICTION

    These Terms of Use are governed by and to be interpreted in accordance with laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these Terms of Use or any dispute arising in relation to the Platforms, whether in contract or tort or otherwise, to submit to the jurisdiction of the courts located at Kolkata, India for the resolution of all such disputes.

11. FORCE MAJEURE

    We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond our reasonable control.

12. WAIVER

    No provision in these Terms of Use will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by us. Any consent by us to, or waiver of your breach, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

13. AMENDMENTS

    We reserve the right to make changes to our policies, and these Terms of Use at any time. You will be subject to the policies and Terms of Use in force at the time you order Product from us, unless any change to those policies or these Terms of Sale is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
